Damages for delay in issuing residence permit: Turin Police Headquarters condemned

The Court of Turin, with judgment of 26 January 2026 (Judge Marongiu), has upheld the appeal represented by lawyers Elena Garelli and Alberto Pasquero of Studio Legale Oltre, condemning the Ministry of the Interior and Turin Police Headquarters to compensate for pecuniary damages resulting from the delay of over two years in issuing a residence permit for family reasons. The applicant had submitted the application in February 2023, but the permit was issued only in June 2025, well beyond the 60-day deadline provided by law.

The judgment confirms that the unjustified delay by the public administration in issuing a residence permit constitutes unlawful conduct pursuant to Article 2043 of the Civil Code and gives rise to compensation for damages actually suffered, including loss of employment opportunities and failure to receive unemployment benefits.
